This document is a legally binding agreement between you (the participant) and No Man Left Inside CIC (Company Registration Number – 17128307), including its directors, trustees, volunteer coordinators, coaches, session leaders, venue hosts and agents (collectively referred to as “NMLI”, “we”, “us” or “our”). By creating an account, registering for an event, submitting an RSVP or taking part in any activity organised, hosted or facilitated by No Man Left Inside CIC (including but not limited to outdoor physical exercise, high intensity functional training, weighted endurance challenges, combat sports drills such as boxing and pad work, open water swimming, river dips, cold water exposure, community walks, runs and overnight retreats) you explicitly confirm that you have read, understood and agreed to be bound by the following comprehensive terms:
1. Nature of the Activities and Environmental Hazards
NMLI activities are physically demanding, dynamic and conducted across diverse indoor and outdoor environments throughout the United Kingdom. These environments include public parks (such as Williamson Park), open water locations (including river sites at Woodies car park), indoor sports venues (such as Lancaster Boxing Club), trails, coastal areas and mountainous or woodland terrain on retreats in regions such as the Lake District. You acknowledge that these activities and environments carry substantial inherent risks that cannot be entirely eliminated, regardless of the care taken by organisers. These physical and environmental risks include but are not limited to;
- Physical Exertion and Musculoskeletal Injury – Muscle tears, strains, sprains, fractures, joint dislocation, structural fatigue, cardiovascular strain and physical exhaustion resulting from bodyweight movements, calisthenics, running, carrying weighted equipment or bag and pad work.
- Terrain and Environmental Dangers – Uneven, slippery, steep, wet or muddy ground, loose gravel, rocks, roots, concealed or submerged debris, traffic and collisions with other participants, members of the public or equipment.
- Weather and Atmospheric Hazards – Rapidly changing weather systems, rain, extreme cold, wind chill, heat exhaustion, dehydration and sun exposure.
- Combat and Partner Drills – Physical contact during boxing training, pad work and controlled combat drills. While sparring and aggressive striking are not permitted, accidental contact, misdirected strikes or joint strain can occur. Weighted Team Challenges – Moving heavy, awkward loads across uneven ground, including participating in multi man stretcher runs and carries, which impose distinct physical demands on the back, core and shoulders.
2. Specific Cold Water Immersion and Open Water Warning
Open water swimming, dipping and cold water exposure involve severe physiological stressors that require strict personal caution.
- Physiological Shock – Sudden immersion in cold water can trigger cold water shock, involuntary gasping, rapid hyperventilation, cardiac arrhythmia, panic, immediate loss of manual dexterity and severe disorientation.
- Drowning and Submersion Risks – Hidden currents, sudden drop offs, underwater obstacles, poor visibility and muscle incapacitation due to cold can lead to distress or drowning.
- Hypothermia – Prolonged exposure or inadequate rewarming post dip significantly raises the risk of mild to severe hypothermia.
- Participant Protocols – You agree to enter all water bodies slowly, deliberately and strictly at your own pace. You must never dive headfirst. You must exit the water immediately if you experience dizziness, intense shivering, pain, numbness, mental confusion or distress. You are solely responsible for bringing adequate rewarming gear (including warm, dry layers, windproof outerwear, footwear and towels) for immediate use after exiting the water.
3. Voluntary Participation and Assumption of Risk
You declare that you are participating entirely of your own free will and at your own personal risk. You fully recognise that no individual is forced or pressured to undertake any specific movement, lift, run, strike or cold water dip. You knowingly, freely and expressly assume total responsibility for all ordinary and extraordinary risks associated with your participation, including any property damage, physical injury, illness, permanent disability or death, whether caused by the natural environment, your own actions or the collective nature of group physical training.
4. Medical Assessment and Physical Fitness Declaration
You represent and warrant that you are physically capable, mentally prepared and in suitable medical health to take part in strenuous exercise and outdoor activities.
- Pre Existing Health Conditions – If you have a history of heart disease, cardiovascular irregularity, high blood pressure, asthma, respiratory disorders, epilepsy, neurological conditions, diabetes, recent surgery, hernia, joint or spinal weakness, or any ongoing condition that may be aggravated by vigorous physical training or temperature extremes, you must obtain explicit clearance from a registered medical practitioner (GP) before attending.
- Self Certification – You confirm that you will not participate if you are suffering from an acute infection, injury, unmanaged illness, fever or any impairment that makes participation unsafe for yourself or others.
- Sobriety – You strictly agree not to attend or participate in any session while under the influence of alcohol, unprescribed drugs, recreational substances or medications that impair motor coordination, judgement or alertness.
- No Medical Advice Provided – NMLI is a peer support and community exercise initiative. Session coordinators, coaches and volunteers are not medical doctors, licensed physiotherapists or mental health practitioners. Advice shared during gatherings is grounded in lived experience, community support and general fitness instruction, and must never be treated as professional medical, psychiatric or clinical advice.
5. Mandatory Disclosure of Medical Information
You agree to notify session leaders and organisers prior to the commencement of any activity of any medical issue, allergy, physical limitation, prescription medication (such as asthma inhalers or adrenaline auto injectors) or accessibility requirement that may reasonably impact your safety, performance or emergency treatment. You understand that disclosing information does not transfer legal responsibility for your wellbeing to NMLI, and you remain responsible for self monitoring your physical state at all times.
6. Adherence to Instructions, Safety Rules and Zero Ego Culture
NMLI operates on the core principles of mutual respect, personal discipline and brotherhood.
- Coach Instructions – You agree to pay full attention to all pre session safety briefings and strictly adhere to all directions, rules and guidelines issued by session leaders, coaches, safety volunteers and facility staff.
- Pacing and Scaling – Sessions are designed to be accessible to all fitness levels. You are expected to self regulate, scale back intensity, take breaks or stop entirely whenever you feel unable to continue safely.
- Removal from Sessions – NMLI maintains a zero tolerance policy for aggressive behaviour, unsafe conduct, harassment or reckless actions that endanger other participants. Organisers reserve the absolute right to refuse, suspend or terminate your participation in any session, drill or dip at their sole discretion if they deem your continued involvement unsafe for you or the wider group.
7. Personal Property and Equipment Responsibility
You retain total responsibility for your personal belongings, clothing, vehicles and equipment throughout every event. NMLI accepts no liability for loss, theft or damage to personal items, vehicles, wallets, electronic devices or clothing brought to training sessions, gym facilities, parks or open water muster points. You are responsible for ensuring that your own training kit (including running shoes, weather appropriate apparel and personal boxing hand wraps or gloves where applicable) is maintained in safe, functional working order.
8. First Aid and Emergency Medical Authorisation
In the event of an acute injury, physical collapse, hypothermia, heat stroke or sudden medical emergency:
- You grant full permission to NMLI session coordinators, coaches and appointed first aiders to administer immediate basic first aid, CPR or automated external defibrillation (AED) where available.
- You authorise NMLI representatives to summon emergency medical services (such as paramedics, ambulance, mountain rescue or HM Coastguard) on your behalf whenever deemed necessary.
- You accept full responsibility for any personal costs associated with independent emergency medical transport or subsequent medical treatment.
9. Swimming Proficiency and Water Safety
Participation in any river dip, lake swim or water based gathering is strictly discretionary.
- You acknowledge that open water presents hazards fundamentally distinct from heated indoor pools, including zero visibility, deep silt, cold currents and absence of lifeguards.
- You confirm that you will only enter the water if you feel physically confident in your ability to manage your buoyancy and movements in unheated open water.
- If requested by a session coordinator, you agree to provide an honest, accurate assessment of your swimming capability and open water experience before setting foot in the water.
10. Comprehensive Limitation of Liability
To the fullest extent permissible under the laws of England and Wales:
- Neither No Man Left Inside CIC, nor its directors, officers, employees, volunteer coaches, event leaders, partner organisations or venue hosts (including but not limited to Lancaster Boxing Club and local council estates) shall be held liable under contract, tort, common law or statute for any direct, indirect, incidental or consequential loss, injury, illness, emotional distress or damage suffered by you as a consequence of participating in any NMLI event, activity, training session or retreat.
- You release, waive and forever discharge NMLI and its representatives from any and all legal claims, demands, damages and causes of action arising from normal operational training risks.
- Statutory Exception – Nothing within this disclaimer attempts to exclude, restrict or limit the liability of NMLI for death or personal injury caused directly by its own proven negligence, fraudulent misrepresentation or any other liability which cannot lawfully be excluded under the laws of England and Wales.
11. Media, Photography and Data Protection
Photography and Videography – Photographs and video footage are regularly recorded during NMLI outdoor training sessions, boxing clinics and community events for peer support, website documentation, social media channels and charity awareness. By taking part, you understand that your likeness may be captured in group photography. If you do not wish to be included in public promotional material, you must inform the session leader prior to the start of the event or adjust your preferences in your account profile.
Data Processing – All personal data, contact details, emergency information and medical declarations submitted via registration forms or RSVP systems are stored securely and processed in strict compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, as detailed in the official NMLI Privacy Policy.
12. Governing Law and Jurisdiction
This disclaimer, assumption of risk and liability release agreement shall be governed exclusively by and construed in all respects in accordance with the laws of England and Wales. Any dispute, controversy or claim arising out of or relating to your participation in NMLI activities, event bookings or the interpretation of this document shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Digital Declaration and Confirmation
By ticking the mandatory agreement box on the website registration form, submitting an event booking or signing an attendance register, you confirm that:
- You have carefully read and fully understood every section of this document.
- You have had ample opportunity to consider its terms, seek independent advice if desired and raise any safety questions with NMLI organisers before taking part.
